1. Agreement to Terms

Welcome to FX Solar. These Terms and Conditions constitute a legally binding agreement between you (the "Customer", "User", or "Client") and FX Solar ("we", "us", or "our"). They govern your use of our website (fxsolar.com.au) as well as the provision of solar design, engineering, equipment supply, installation, testing, and commissioning services across Queensland, Australia.

By browsing this website, requesting a quote, or signing a formal installation proposal, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

3. Website Usage & Intellectual Property

All materials published on fxsolar.com.au — including engineering diagrams, text, layout designs, system calculators, product comparisons, brand graphics, and installation photographs — are protected by Australian and international copyright and trademark laws.

You may access and download materials for personal, non-commercial evaluation of solar energy solutions. You must not copy, reproduce, republish, or commercially exploit any content from this site without our prior written consent.

4. Quotations, Site Feasibility & System Design

All solar photovoltaic (PV), battery storage, and EV charging proposals issued by FX Solar are subject to the following conditions:

• Validity Period: Written quotations remain valid for 30 days from the date of issue, unless otherwise specified in writing.
• Site Feasibility: Quotes are based on available aerial imagery, architectural drawings, and information provided by the customer. A quote is subject to physical site inspection to verify roof structural integrity, switchboard capacity, and conduit pathways.
• Variations: If on-site inspection reveals that non-standard switchboard upgrades, asbestos remediation, tile repairs, or extensive trenching are required to meet AS/NZS 3000 safety standards, we will provide a written variation notice before commencing work. If you do not accept the variation, you are entitled to a full refund of any deposit paid.

5. Network Connection Approvals (DNSP)

Grid-connected solar systems require approval from the relevant Distribution Network Service Provider (DNSP), such as Energex or Ergon Energy Network in Queensland. FX Solar manages the entire network application process on your behalf:

• Approval is subject to network constraints, phase capacity, and local substation export limits (e.g. standard 5kW single-phase export limits).
• If the network distributor rejects the application or imposes unexpected technical limitations that cannot be resolved cost-effectively, the customer may cancel the contract with a full refund of any deposit paid.

6. Government Rebates & STC Assignment

Under the Australian Federal Government's Small-scale Renewable Energy Scheme (SRES), eligible solar installations generate Small-scale Technology Certificates (STCs):

• The quotation provided to you already reflects the upfront STC discount, reducing your out-of-pocket payable cost.
• In exchange for this point-of-sale discount, you agree to assign the right to create and register all STCs generated by the system to FX Solar or its nominated agent.
• You agree to sign all necessary STC assignment documentation on or upon completion of installation. If the customer fails to assign the STCs, the customer remains liable to pay the full gross value of the system without the rebate discount.

7. Pricing, Payment Milestones & Title

Payment terms for solar installation contracts are structured transparently:

Title & Risk: Risk of loss or damage to equipment passes to the customer upon delivery to the site. Legal title and ownership of all equipment remain with FX Solar until the total contract price is paid in full.

8. Installation Process, Access & Safety

To ensure a safe and efficient installation, the customer agrees to:

• Provide clear, unobstructed access to the roof, switchboard, meter box, and electrical sub-boards on the scheduled installation date;
• Ensure domestic animals are secured away from work areas;
• Provide access to household 240V electricity and a standard Wi-Fi network connection for inverter monitoring configuration.

Our Clean Energy Council (CEC) accredited electricians strictly adhere to Work Health and Safety (WHS) regulations, including roof harness safety, fall arrest equipment, and switchboard isolation protocols.

11. Cooling-Off Periods, Cancellations & Refunds

Under unsolicited consumer agreement provisions and the Clean Energy Council Solar Retailer Code:

• If your contract is subject to unsolicited sales rules, you have a statutory 10 business day cooling-off period to cancel with a 100% full refund of all moneys paid.
• If FX Solar makes a significant variation to the system design or equipment without your prior consent, you may terminate the contract and receive a full deposit refund.
• If network connection approval is denied by the distributor through no fault of the customer, the agreement may be terminated with a full refund.

12. Limitation of Liability & Force Majeure

FX Solar is not liable for delays or failures caused by events beyond our reasonable control (Force Majeure), including extreme severe weather events (e.g. cyclonic storms, bushfires), energy network grid failures, or unforeseen international supply chain embargoes. In such events, installation timelines will be extended reasonably.

13. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Queensland, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Queensland.
